General Conditions of Sale

These General Conditions of Sale (the “Conditions”) govern the distance sale contracts for the products offered on nectaressenze.com by Ragazzoni SAS di Paradiso Paolo & C. and apply to all orders placed by consumers. They form an integral part of the Site's Terms and Conditions.

1. Definitions

  • Seller: Ragazzoni SAS di Paradiso Paolo & C., Via Daniele Crespi 1/3, 20027 Rescaldina (MI), Italy, VAT 12867510963.
  • Customer / Consumer: the natural person purchasing for purposes unrelated to their business or professional activity.
  • Products: the seafood/food goods offered on the Site.
  • Consumer Code: Legislative Decree 206/2005 as amended.

2. Scope

These Conditions apply to all sales concluded through the Site. By placing an order, the Customer fully accepts the Conditions in force at the time the order is submitted. Any different conditions of the Customer do not apply unless agreed in writing.

3. Order and conclusion of the contract

The order submitted through the Site constitutes a contractual proposal. The contract is concluded upon the order confirmation email sent by the Seller.

Before submitting, the Customer may review and correct input errors in the cart. The Seller reserves the right to reject incomplete orders or orders for unavailable products.

4. Prices

Prices are in Euro and include VAT. Shipping costs, if any, are shown before order confirmation. The applicable price is the one published on the Site at the time of the order.

5. Product characteristics

The Products are fresh, perishable and seasonal food. Weight, size and appearance may vary slightly due to the nature of the product. Availability depends on the daily catch and sea conditions.

6. Shipping and delivery

Delivery is made with refrigerated transport (0 to 4 °C) within the served areas, from Tuesday to Saturday by 1:00 PM. As these are perishable goods, the Customer ensures a recipient is present at the indicated address. Risk passes to the Customer upon delivery.

7. Payment methods

Payment is due at the time of the order through the secure checkout provided by Shopify.

  • Credit/debit cards and major digital wallets.
  • Instalment payment via Scalapay, where available, under the relevant provider's terms.

8. Right of withdrawal and exclusions

Pursuant to art. 52 et seq. of the Consumer Code, consumers generally have 14 days to withdraw from distance contracts.

Pursuant to art. 59 of the Consumer Code, the right of withdrawal is excluded, among others, for goods liable to deteriorate or expire rapidly and for sealed goods that cannot be returned for hygiene reasons once unsealed. Since the Products are fresh, perishable and/or sealed for hygiene reasons, the right of withdrawal does not apply to purchases made on the Site.

Electronic withdrawal function. For any non-perishable, non-excluded products where a right of withdrawal exists, the Customer may exercise it under art. 54-bis of the Consumer Code (Legislative Decree 209/2025) by sending an explicit statement, including via the model form (Annex I, part B), to info@nectarexperience.it; the Seller will acknowledge receipt on a durable medium.

9. Legal guarantee of conformity

The Products are covered by the legal guarantee of conformity (art. 128 et seq. of the Consumer Code). Given their perishable nature, any defects or quality issues must be reported within 24 hours of delivery with photographic documentation, as per the Return and Refund Policy.

10. Complaints and support

Complaints may be sent to info@nectarexperience.it or via WhatsApp at +39 350 973 9271 and are handled within 48 hours of the report.

11. Liability and force majeure

The Seller is not liable for failures due to force majeure or unforeseeable events, nor for improper storage of the perishable Products by the Customer after delivery.

12. Applicable law and jurisdiction

These Conditions are governed by Italian law. For disputes with consumers, the court of the consumer's residence or domicile, if in Italy, has exclusive jurisdiction. The right to resort to alternative dispute resolution (ADR) bodies under art. 141 et seq. of the Consumer Code is reserved.
